Platform relationship

Platform and daycare responsibilities

How liability and duties are divided so misuse by a daycare does not extend to the platform.

1. Purpose

This section describes how responsibilities are divided between DaycareMate (the platform) and Bloomwave (the daycare). It is intended to protect families, the daycare, and the platform when the software is used to manage childcare operations.

2. Independent roles

  • Bloomwave is the childcare provider and is responsible for the children, families, staff conduct, and regulatory compliance in its facility.
  • DaycareMate provides software tools only. We do not supervise children, employ daycare staff, or make childcare decisions.
  • Nothing in the use of DaycareMate creates a partnership, agency, or joint venture between the platform and the daycare.

3. Daycare obligations

When using DaycareMate, the daycare agrees to:

  • Collect and use personal data lawfully, with appropriate notices and consents
  • Enter only accurate information and keep records up to date
  • Restrict staff access to information required for their role
  • Send communications only to appropriate recipients (for example enrolled families and authorised staff)
  • Not use the platform for unsolicited marketing, purchased lists, or unrelated purposes
  • Respond promptly to parent requests about childcare data in the daycare's control
  • Comply with applicable childcare, privacy, and consumer-protection laws

4. Platform limitations

DaycareMate is not responsible for:

  • The accuracy, legality, or appropriateness of content entered by the daycare or its staff
  • Decisions made by the daycare regarding admission, discipline, fees, or care
  • Emails or messages composed and sent by the daycare using the platform
  • Losses arising from the daycare sharing logins, misconfiguring access, or failing to train staff
  • Events outside our reasonable control (for example internet outages or third-party failures)

The platform provides tools; the daycare remains accountable for how those tools are used in its operations.

5. Prohibited uses

The daycare must not use DaycareMate to:

  • Upload unlawful, harmful, or unrelated content
  • Harass, spam, or mislead parents or staff
  • Process data without a valid basis or required notices
  • Circumvent security, access controls, or usage limits
  • Impersonate another person or misrepresent the daycare's identity

6. Enforcement and suspension

If we reasonably believe a daycare has misused the platform, violated these guardrails, or created deliverability, security, or legal risk, DaycareMate may warn, restrict, or suspend access, and may cooperate with regulators or email providers as required. We may preserve logs and evidence as needed to investigate abuse.

7. Indemnity and allocation of risk

To the fullest extent permitted by law, the daycare agrees to defend and hold harmless DaycareMate and IGENTX from claims, fines, penalties, or costs arising from the daycare's use of the platform, including unlawful communications, missing consents, incorrect recipient lists, staff misconduct, or regulatory breaches relating to childcare operations — except where caused by the platform's own intentional misconduct or gross negligence in providing the software.

8. Regulatory and data-subject requests

  • Requests about a child's care, enrolment, or daycare communications should be directed to Bloomwave.
  • Requests about the DaycareMate software, security, or infrastructure may be directed to the platform via https://daycaremate.com.
  • We will assist the daycare with technical requests where required by law, subject to our standard support processes.

9. Changes

We may update platform policies and guardrails as the service evolves. Material changes will be communicated through the product or to daycare administrators. Continued use after notice constitutes acceptance of the updated terms, unless otherwise required by law.
